This is the reverse of the normal GST process, where the supplier collects GST from the buyer and remits it to the government.

    • Under RCM, the buyer/recipient pays the GST instead of the seller/supplier.

    • Services provided by individuals under specified categories.
  3. GST Registration Requirement:
    • Recipients liable under RCM must be registered under GST, regardless of the ₹20 lakh/₹10 lakh turnover threshold.
  4. Input Tax Credit (ITC):
    • The recipient can claim ITC on GST paid under RCM, provided the goods or services are used for business purposes.

Scenarios Where RCM is Applicable

  1. Notified Goods and Services:
    • E.g., transport services by Goods Transport Agencies (GTA), legal services provided by an advocate, or services provided by a director of a company.
  2. Transactions with Unregistered Suppliers:
    • If a registered person purchases goods/services from an unregistered supplier, they must pay GST under RCM.
  3. Import of Services:
    • If services are imported into India, the recipient is liable to pay GST under RCM.

Scenario: Renting of Residential Property for Business

  • Landlord: An individual (not registered under GST) rents a residential property to a business entity for use as a guest house.
  • Tenant: A GST-registered company.
  • Applicability: GST at 18% is applicable under RCM.
  • Outcome:
    • The tenant (business) is responsible for paying the GST directly to the government.
    • The tenant can claim ITC if the property is used for taxable business purposes.

Advantages of RCM

  • Simplifies tax compliance for small or unregistered suppliers.
  • Encourages GST compliance by shifting responsibility to larger businesses.
  • Reduces tax evasion.

Disadvantages of RCM

  • Increases compliance burden on buyers/recipients.
  • Requires careful accounting and reporting of RCM transactions.
